The day after the election, local electoral boards will research the ballot and decide on a case-by-case basis whether to count your vote or not. You may also be asked to cast a provisional ballot if the normal voting hours are extended by a court order. Banned Items At Polling Precincts Virginia law bans clothing, hats, buttons or other campaign paraphernalia that expressly advocates the election or defeat of a candidate or issue within 40 feet of any entrance to a polling place. The Virginia State Board of Elections banned these items in October from polling place. Also, cell phones and PDAs must be turned off if you are inside the polling precinct. Registrars throughout the NRV will be enforcing this state law, which is a Class 1 misdemeanor. You will be allowed to vote, even if you fail to remove or cover the item, however, your name and address will be turned over to the Commonwealth Attorney for possible prosecution.
