A Radford jury found James Jones II not guilty of capital murder this morning in Radford Circuit Court.
Although Jones was found not guilty on the capital murder charge, the jury did find him guilty of robbery, conspiracy and using a firearm in the commission of a felony. Sentencing for Jones will start this afternoon. The jury of eight women and four men was not given an option to find Jones guilty of a lesser murder charge. Jones was accused of killing Ken Henry, 39, and robbing him of money and drugs outside of Kelly Brubeck’s Davis Street apartment on July 5, 2006. Brubeck, Jones’ former fiancé, originally told police the day of her arrest that she shot Henry in self-defense. She later told police that she lied and that Jones was the one that shot and killed Henry. Brubeck is charged with second degree murder in the case. She is scheduled for trial at a later date.
